Which Judicial Philsophy do you agree with- judicial restraint or judicial activism?
¨Judicial restraint- believe that judges should decide cases on the basis of (1) original intent of the Framers or those who enacted the statue(s) involved in a case, and (2) precedent- a judicial decision that serves as a guide for settling later cases of a similar nature.

¨Judicial activism- Argue that provisions in the Constitution and in statue law should be interpreted and applied in the light of ongoing changes in conditioning and values- especially in cases involving civil rights and social welfare issues.

I agree with the Judicial Restraint that judges should decide the cases on the basis of original intent.
